To satisfy due process, voluntary drugging of an incompetent insanity pleader would need to meet these criteria: (1) medication was medically appropriate and, considering less intrusive alternatives, essential for the sake of the defendant’s own safety or the safety of others, or (2) medication was medically appropriate, and without involuntary treatment, there could be no adjudication of the defendant’s guilt or innocence by using less intrusive means.
