In order to score “yes” on item 5 of the JSORRAT-II the offense must be a felony-level, “hands-on” sexual offense that occurred in a public place; counting misdemeanor-level (“hands-off”) sexual offenses such as “mooning” on this item causes the predictive validity of item 5 to be lost.
